SALE CATALOG ETUDE MIRABAUD MERCIER

MARCH 2022 IN PARIS

Regulatory reminder:

The specimens presented in this auction comply with the law. Indeed, the legislator imposes strict rules for the commercial use of inert animal specimens. The International regulation of March 3, 1973 (CITES) imposes for the various appendices a correlation between the specimen and the document proving the legal origin. This regulation transcribed into European Community law (Annexes A/B/C) in the Regulation 338/97 of 9/12/1996 allows the commercial use of regulated specimens (CITES) subject to the presentation of documents or dating elements proving the legal origin; these documents for this session are the following:

For recent specimens listed in the Washington Convention,

- For Appendix A: CIC provided with the history of the specimen (for recent specimens)

- For Appendix B: avian specimens are either banded or transponded, and are accompanied by legal documentation of origin. The adjudication slip of this session must be kept as it contains the history of each specimen.

For the recent protected specimens listed in the French Environment Code, they are all born and bred in captivity and benefit from the derogation of the AM of 14/07/2006. They can therefore be used commercially in view of the traceability between the specimen and the documents justifying the legal origin. The other specimens benefiting from dating prior to the application regime (AM of 21/07/2015) can therefore be used commercially.

For the specimens prior to 1947 present in this vacation, they benefit from the derogatory case of the Rule 338/97 of 9/12/1996 in its article 2 mc allowing their commercial use. On the other hand, for the exit of the EU of these specimens a Cites pre-convention is necessary.

For the specimens of huntable species (CH) of the European continent and others, the commercial use is allowed under certain conditions.

For the so-called domestic species (D) present in this vacation, the commercial use is free.

For the old specimens known as pre-convention (before 1975), they respect the conditions of the AM of 23/12/2011 and thus, can be used commercially.

The other specimens of this auction are not subject to regulation (NR) and are free of any commercial use. The adjudication slip will serve as proof of legal origin.

For an exit from the EU, concerning Appendices I/A, II/A, II/B, III/C a CITES re-export will be necessary.

Remark : The firm MIRABAUD MERCIER, and the Expert will decline any fraudulent use of the specimens put up for sale in this auction, other than those fixed by the Law, the Auctioneer, and the Expert.
