VACATION DU 22 SEPTEMBRE 2020 A PARIS
Regulatory reminder :
The specimens presented in this session comply with the Law. Indeed, the Legislator imposes strict rules for the commercial use of specimens of inert animals. The International Regulation of 3 March 1973 (CITES) imposes for the different appendices a correlation between the specimen and the document proving the licit origin. This regulation transcribed in European Community law (Annexes A/B/C) in the Rule 338/97 of 9/12/1996 allows the commercial use of regulated specimens (CITES) subject to the presentation of documents or elements of dating proving the licit origin; these documents for this session are the following:
For Appendix B: Avian specimens are either banded or transplanted, and are accompanied by documents of legal origin. The contract award slip for this session must be kept as it includes the history of each specimen.
For recent protected specimens listed in the French Environment Code, they are all born and bred in captivity and benefit from the derogatory case of the AM of 14/07/2006. They can therefore be used commercially in view of the traceability between the specimen and the supporting documents of legal origin. The other specimens benefiting from dating prior to the application regime (AM of 21/07/2015) can therefore be used commercially.
For specimens prior to 1947 present in this session, they benefit from the derogatory case of Rule 338/97 of 9/12/1996 in its Article 2 mc allowing their commercial use. On the other hand, for the exit of these specimens from the EU, a Pre-Convention Quotation is necessary.
For specimens of huntable species (CH) from the European continent and others, commercial use is permitted under certain conditions.
For the so-called domestic species (D) present in this session, commercial use is free.
The other specimens of this radio session are not subject to regulation (NR) and are free of all commercial use. The auction slip will serve as a legal document of origin.
For an exit from the EU, concerning Appendices I/A, II/A, II/B, III/C, and Appendix D a CITES re-export will be necessary.
